We collect personal information about you automatically when you:

Our servers automatically record certain information sent by your browser, such as your web page or resource request, your IP address or domain names of the computers you use, your referring/exit URLs, your browser type and operating system, the date and time of your request, and other parameters concerning your operating system and computer environment. We also collect your search criteria and shopping history.

Information we collect about you from third parties:
- We collect your personal information from social media and video sharing sites like Instagram, Facebook, Twitter, Pinterest, and YouTube. This includes your email address if you sign-up to our newsletters and your user name or handle if you follow ZIMMERMANN’s social media accounts.
- When you use the Google Maps service on our Site to locate our nearest store, we may use collected geolocation data.
- We also use a social media reporting tool, which provides us with user names and handles of our social media followers. We may obtain information about you as a result of authentication or identity checks (for example you may be asked to identify yourself when you pick up your purchase in store).
We collect and process your personal information on AWS servers in Australia when you:
- Visit our Site. When you visit our Site, we collect your internet activity. We collect this information so that we may:

  - If you make a purchase at one of our stores, we collect your identifiers, financial information, commercial information, possibly other personal information provided by you, and inferences from those categories.
  - When you make a purchase either on our Site or in our stores, we collect this information so that we may:
    Communicate with you and receive, process, confirm, send, and track your order and requests, as well as associated activities such as administrative management of the contract, payment processing and fraud prevention

If available, we also collect your internet activity information and commercial information. We collect this information so that we can:

- Troubleshoot where necessary, diagnose technical and service problems, and address any issues you have with our Site or Services

Create an account with us. When you create an account, we collect your identifiers, so that we may:

When you sign up for Store Communication. When you sign up for our Store Communication, you may receive personalised communication relating to your purchases, profile, or Zimmermann services. We may contact you via email, text, phone, post, or social media. The legal basis for this processing is your consent and you can revoke your consent at any time by emailing clientservices.eu@zimmermann.com, or notifying a staff member in store, asking to unsubscribe from ‘Store Communication’.
Accept an invitation to join a loyalty program. If you are included in a loyalty program, we process your identifiers, commercial information, financial information, internet activity information, and inferences from those categories. We collect this information so that we may:
- Communicate with you
- Track your purchases to confirm your eligibility on an annual basis
- The legal basis for this processing is performance of our contract with you.
Maintain and improve our business, Site, and Services. To maintain and improve our overall business, we collect your identifiers, commercial information, and internet activity information. We collect this information so that we may:
- Administer our Site and improve our Site usability
- Track user movements on our Site
- Gather broad demographic data for aggregate use for benchmarking and marketing.

We also use pixels and tags to understand user trends so that we can provide an optimal browsing and shopping experience for our customers. Through these trackers we also process click through information from our marketing emails to our Site.

Facebook Pixel. We use Facebook Pixel to customize our advertising and to serve you ads on your social media based on your browsing behavior. This allows your behavior to be tracked after you have been redirected to our website by clicking on the Facebook ad. The Facebook Pixel stores a cookie on your device to enable us to measure the effectiveness of Facebook ads for statistical and market research purposes. We do not have access to the information collected through the Facebook Pixel. However, the information collected via the Facebook Pixel, on our website as well as other websites on which Facebook Pixel is installed, is also stored and processed by Facebook. Facebook may link this information to your Facebook account and also use it for its own promotional purposes in accordance with Facebook's Data Usage Policy. The Facebook Pixel also allows Facebook and its partners to show you advertisements on and outside of Facebook. Such sharing may be deemed a sale under the California Consumer Privacy Act. ZIMMERMANN does not presently use Ad Choices. - Within the ZIMMERMANN corporate group. We may share your identifiers, commercial information, internet activity information, and inferences regarding the described categories of information within our corporate family, such as our subsidiaries or affiliates to the extent permitted by law. The legal basis for this is our legitimate interest in carrying out or business operations efficiently. If you register with the Zimmermann client database, your personal information will be managed by Zimmermann Wear Pty Ltd as data controller, an entity in the same corporate group.
- Service Providers. We may share your identifiers, financial information, internet activity information, commercial information, and inferences regarding the described categories of information, with our service providers (including our website developers, IT services, email marketing platforms, social media reporting tools, financial institutions, and distribution and delivery services) to perform services for or on our behalf. We share this information in order to perform marketing activities and back in stock notifications, conduct surveys, validate your employment application, deliver your order, notify you with updates regarding your order, and trouble shooting. The legal basis for this sharing is our legitimate interest in providing the Services more efficiently.
- Corporate Reorganization. In the event we enter into, or intend to enter into, a transaction that alters the structure of our business, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our business, assets or stock, your personal information would be part of the assets shared with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction. - For legal purposes. We will share personal information where we are legally required to do so, such as in response to court orders, law enforcement or legal processes; to establish, protect, or exercise our legal rights or contractual obligations; to defend against legal claims or demands; to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person; or to comply with the requirements of any applicable law. The legal basis for this processing is compliance with a legal obligation applicable to us, our legitimate interest in compliance with other laws applicable to ZIMMERMANN, and our legitimate interest in the protection of the rights of others.
- With Your Consent. Apart from the reasons identified above, we may request your permission to use or share your personal information for a specific purpose. We will notify you and request consent before you provide the personal information, or before the personal information you have already provided is used or shared for such purpose. You can revoke your consent at any time.
- As Zimmermann is part of an international network and uses global services, your personal information may be shared with other Zimmermann group entities and stored overseas in accordance with applicable legislation, including in Australia and Ireland. Zimmermann adopts all appropriate security measures and safeguards to ensure an appropriate level of data security.

For a Business Purpose
In the preceding 12 months, we have disclosed the following categories of personal information for a business purpose with the following categories of third parties:
- We have disclosed your identifiers and internet activity information to companies that provide us with IT systems support.
- We have disclosed your identifiers, financial information, and customer records information to data analytics providers and other third parties to help perform services, including, maintaining or servicing customer accounts, providing client services, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing advertising or marketing services, providing analytics services, providing email communications, providing delivery services, and hosting our Site.
- We have disclosed your identifiers, and internet activity information to IT support and data analytics providers to detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and to identify and repair Site errors that impair functionality.
For a Sale. Certain sharing we engage in may be considered a sale under the California Consumer Privacy Act. In the preceding twelve (12) months, we have sold your internet or other electronic network activity collected via cookies to data analytics providers and ad networks. You may opt-out of the use of these cookies by following the instructions in How To Opt Out Of Cookies below.
We have also disclosed personal information you have shared with us, like your identifiers and commercial information, with our corporate family, including our affiliates, to exchange business intelligence. We make all reasonable efforts to ensure that your personal information is stored securely, both in electronic and physical form, and otherwise protect it from misuse, interference and loss caused by unauthorized access, modification or disclosure with security measures such as access controls. Our employees and agents are obliged to treat any personal information held by us confidentially.

You can request deletion of your account by contacting us at clientservices.eu@zimmermann.com.
We will retain your personal information until the earlier of (i) the information is no longer necessary to accomplish the purpose for which it was provided; or (ii) we delete your information pursuant to your request. We retain your personal information for longer periods for specific purposes to the extent that we are obliged to do so in accordance with applicable laws and regulations and/or as necessary to protect our legal rights or for certain business requirements. Below are some more specific reasons we would retain some data for longer periods of time:
- Security, Fraud & Abuse Prevention. For example, to protect you, other people, and us from fraud, abuse, and unauthorized access.
- Financial Record-Keeping. When you make a payment to us we are often required to retain this information for a longer period of time for purposes of accounting, dispute resolution, and compliance with tax, anti-money laundering, and other financial regulations
- Comply With Legal or Regulatory Requirements. To meet any applicable law, regulation, legal process or enforceable governmental request, as required to enforce our terms of service, including investigation of potential violations
- Direct Communications With Us. If you have directly communicated with us, we may retain reasonable records of those communications.
Even if you delete your account or personal information, please keep in mind that the deletion by our third-party providers may not be immediate and that the deleted information may persist in backup copies for a reasonable period of time.
Marketing. We may use your identifiers to provide you with relevant consumer information, notify you of products, store openings and offers that may be of interest to you. Inside chat service. We use a third-party service, Inside Chat, to provide the live chat function on our website, which involves use of cookies to track and log consumer activity on the website. ZIMMERMANN will not intentionally collect personal information via Inside Chat, but may aggregate data collected on the ZIMMERMANN website, with or without data collected from other sites. You have the option to opt out of tracking by contacting Client Services. Live chat communications may be shared with ZIMMERMANN’s service providers (including in real time) in connection with the provision and maintenance of the live chat service. ZIMMERMANN keeps records of live chat communications which may be shared with its service providers for the purpose of delivering an optimised service and experience to you.

Your Rights Under the General Data Protection Regulation
The General Data Protection Regulation provides for rights of access, modification and deletion of your personal information.

If our processing of your personal data is subject to the European Union General Data Protection Regulation 2016/679 (GDPR), you have the following rights under the GDPR:
- Right to Access. You have the right to ask us for copies of your personal information. This right has some exemptions, which means you may not always receive all the personal information we process.
- Right to Rectify You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
- Right to Erasure. You have the right to ask us to erase your personal information in certain circumstances.

We do not support Do Not Track (DNT). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.
This Site and our Services are not intended for individuals under the age of 16 years. If you are a minor, you should obtain the consent of your parent or legal guardian prior to providing your personal information. If we discover that we have collected personal information about a minor without the prior consent of a verifiable parent or legal guardian, we will de-activate the minor’s account and delete the information.
Zimmermann U.K. Limited collects data by a video surveillance system, which allows the filming and recording of customer images at the time of access to its stores.
The purpose of the video surveillance activity is to ensure safety and the protection of the company's assets, in the legitimate interest of the Data Controller (Article 6(1)(f) of EU Regulation 679/2016.
Access to the areas under video surveillance automatically leads to the collection and recording of the images of the data subjects, consequently, if a data subject does not consent to provide this data, the data subject may not access the premises of the Data Controller.
The recorded data will be processed and stored for a period of time not exceeding the time necessary to achieve the purposes for which the data was collected and/or subsequently processed and consistently with Zimmemann's legal obligations.
The images may be viewed:
- by authorized Zimmermann personnel in compliance with current data protection regulations and with the adoption of appropriate security measures;
- by third parties (e.g. equipment maintenance companies) contracted to carry out specific tasks on behalf of the Data Controller, as Data Processors pursuant to Article 28 GDPR 679/2016, subject to a duty of confidentiality and security of the processing of personal data.
Recorded data may be disclosed upon request made in accordance with the law:
- to police forces;
- to judicial authorities.

Rights of the Data Subject: the data subject may apply to the Data Controller by registered letter to the above address, or by electronic mail to clientservices.eu@zimmermann.com to exercise their rights, as provided for in Articles 15 - 22 of the GDPR. In particular:
(a) the right to request access to the images;
b) the right to obtain the restriction and/or deletion of their personal data, where applicable;
c) the right to object to the processing of their personal data;
d) the right to file a complaint with the supervisory authority (Privacy Guarantor).
The rights to update, supplement and rectify are not exercisable due to the type of personal data collected (images recorded in real time). Since the processing is carried out on the legal basis of the legitimate interest of the Data Controller, the right to data portability under Article 20 of the GDPR is also not applicable.
This Privacy Policy may be updated and changed from time to time. We will post the new Policy on the Site and will indicate the date it goes into effect. If the changes materially affect your rights, our Site will contain a special notice about the changes and, if required by law, will prompt you for your consent for certain changes. Each version of this Privacy Policy will be identified by its effective date, which you can find at the bottom of this Policy.

Returns

The Online Boutique Returns Policy & Process

Subject to these terms, you may return your ZIMMERMANN Online Boutique purchase, including sale items, by either returning it to a ZIMMERMANN Boutique in the country of purchase; or the ZIMMERMANN Europe Online Boutique.
For online purchases, returns other than for faulty goods must be requested and sent back within 15 days from the date of delivery for a refund. We recommend trying on all purchased items once received, to ensure adequate time to return items if necessary.
If you wish to exchange for another item or size, you can do this by returning to the Online Boutique for a refund and then purchasing the new item separately.
Returns only accepted with proof of purchase.
Unless the return is required by law:
- Items must be in original condition (including tags) and must not have been worn, altered or washed.
- Items must not have been used in photography shoots, Instagram posts, online, commercially or for personal gain.
- All packaging (including garment bags) shipped with your order must be returned.
- Every clothing item has a tag attached reading "Once this tag is removed, this garment cannot be returned". Once this tag has been removed, the garment is no longer returnable.
- For all swimwear and lingerie, clients must try on items wearing undergarments. If returned, the protective hygiene strip must remain in place and the top and pant sizes of bikini sets must match. Returns will not be accepted if the protective hygiene strip is removed or altered, the top and pant sized of bikini sets differ, or the item otherwise shows signs of wear.
- Try on shoes on soft surfaces before they are worn as we will not accept shoes returned with sole markings or scratches. Ensure shoes are returned with original shoebox.
- All purchases on cosmetics, underwear, tights, socks, lace leggings, hair clips, hair chignons, hair scrunchies, headbands and hair pins are final sale. We will not accept returns on these items for hygiene reasons.
This policy does not apply to ZIMMERMANN in-boutique purchases or ZIMMERMANN Outlets.
This policy does apply to Phone Orders, with the exception that Phone Orders must be returned through Client Services.
While ZIMMERMANN covers the costs of returns using the prepaid returns label within Europe, return postage costs are not refundable and we do not refund initial shipping charges for goods returned, other than for faulty items. All orders shipped DDP, with duties and taxes included at checkout, will have the full duties and tax amount included in their refund. For orders shipped DDU, Zimmermann will not refund any duties and taxes, these can be claimed from your local tax office.

We offer a free returns courier service for online orders, where available. Follow the steps to use this service.

1. Submit a return request

Submit a return request through the return portal below using your order number and follow the steps provided. A return request must be submitted to receive your refund within normal processing times.

On completion of this process, you will receive an email confirming your return details with your return label included.

You may select a refund for all or some of your items.

2. Pack your item(s)
Carefully pack return item(s) into one package. If your return does not fit in one package, contact Client Services for an additional return label.

Affix your shipping label (page with three barcodes) to the outside of your package.

Do not include the waybill doc and commercial invoice in the package.

3. Return your item(s)

Courier collection

DHL will collect your return on your booked date and deliver it to the Zimmermann Online Boutique for processing. Once collected, use the link in your confirmation email to track your return.

To view, change, or cancel your existing DHL Express return courier booking, go to your DHL Label Confirmation email and follow the steps.

Drop off your package at a DHL location near you. Once dropped off, use the link in your confirmation email to track your return.

If you wish to return your items via an alternative courier service, ZIMMERMANN will not be liable for any loss, damages, or expenses.

Note: We endeavour to process our returns within 5 business days of receiving your return, however, during sale periods this may take 1-2 business days longer.

Once the items have been received, they will undergo a quality review. Once cleared, you will receive your refund on the purchase price (excluding original shipping cost) directly to the original method of payment used for purchase. You will receive email notification once your return is processed, this will occur within 5 business days of receiving your return. During sale periods returns processing may take 1-2 business days longer.
Returns will only be accepted with proof of purchase on items requested and sent back within 15 days from the date of delivery. Items returned outside their respective period will not be accepted. An online return request must be submitted to receive your refund within normal processing times.
Exchange rates for all currencies are locked in for 90 days from the date of purchase and Clients will receive their local currency refund based on the same exchange rate as their original transaction.
